1. Who we are

bsquareafrica.com is operated by BSquare Little Africa, based in Montreal, Quebec, Canada. In this document, “we” and “BSquare Little Africa” refer to that business; “you” refers to anyone who visits the site or places an order on it.

By accessing the site or placing an order on it, you accept these terms. If you do not accept them, do not use the site.

2. Conditions of use

You must have reached the age of majority in your province of residence to place an order, or have the consent of a parent or guardian. Our products are children’s clothing; our buyers are adults.

You agree not to use the site for any unlawful purpose, not to disrupt its operation, and not to extract its content by automated means.

3. Products, colours and availability

Our garments are made from African wax print fabric, in small batches. Because each piece is cut from a length of fabric, the placement of the pattern may vary slightly from one item to the next. That variation is part of the character of the product and is not a defect.

We make every effort to display colours faithfully, but how they appear depends on your screen and cannot be guaranteed.

Quantities are limited. We may change or withdraw a product at any time, without notice.

4. Prices and payment

Prices are shown in Canadian dollars and exclude applicable taxes, which are calculated at checkout. We may change our prices at any time; the price that applies to your order is the one displayed when you place it.

We reserve the right to correct an obvious pricing or description error, even after an order has been placed. In that case we will contact you: you may confirm at the corrected price or cancel for a full refund.

5. Acceptance and refusal of orders

Your order constitutes an offer to purchase. The contract is formed when we send you the shipping confirmation.

We may refuse or cancel an order, in particular where an item is out of stock, where there is a pricing error, where fraud is suspected, or where an order appears intended for resale. Any amount already charged is then refunded in full.

6. Garment care

Wax print fabric may bleed in the first wash. Follow the instructions on the care label. Damage resulting from care that does not follow those instructions is not covered.

7. Returns, refunds and shipping

Our refund policy and our shipping policy form an integral part of these terms.

8. Customer accounts

If you create an account, you are responsible for keeping your credentials confidential and for any activity carried out from your account. Notify us without delay of any unauthorised use.

9. Intellectual property

The content of the site — photographs, text, logo, name and visual identity of BSquare Little Africa — belongs to us or is licensed to us. You may not reproduce, distribute or commercially exploit it without our written permission.

10. Privacy

How we handle your personal information is described in our privacy policy.

11. Third-party services

The site relies on third-party providers, including Shopify for hosting and payment processing, and Canada Post for delivery. We are not responsible for the content or practices of third-party sites we may link to.

12. Warranties and liability

Nothing in these terms excludes the warranties and remedies granted to you by Quebec’s Consumer Protection Act and other applicable legislation. Those rights prevail over any contrary provision.

Subject to the above, our liability to you, whatever its cause, cannot exceed the amount you paid for the order concerned.

13. Changes to these terms

We may change these terms at any time. The version in force is the one published on this page; the last-updated date appears at the top. The terms that apply to an order are those in force when the order is placed.

14. Governing law

These terms are governed by the laws in force in Quebec and by applicable Canadian law. Any dispute falls within the jurisdiction of the courts of the judicial district of Montreal, subject to the remedies the law reserves to you as a consumer, including the option of applying to the Office de la protection du consommateur or the Small Claims Division.
